Texas Privacy Rights (TDPSA)
This Texas Privacy Rights Notice supplements our Privacy Policy and applies to Texas residents. It describes how A+ Hosting Inc. DBA ServerPoint.com ("ServerPoint", "we", "us", "our") collects, uses, and protects personal data in accordance with the Texas Data Privacy and Security Act (TDPSA), effective July 1, 2024.
1. Applicability
The TDPSA applies to entities that conduct business in Texas or produce products or services consumed by Texas residents and that process or sell personal data. This notice provides Texas residents with information about their privacy rights under the TDPSA.
2. Your Rights Under Texas Law
As a Texas resident, you have the following rights regarding your personal data:
Right to Confirm and Access
You have the right to confirm whether we are processing your personal data and to access that personal data.
Right to Correct
You have the right to correct inaccuracies in your personal data, taking into account the nature of the personal data and the purposes of the processing.
Right to Delete
You have the right to delete personal data you have provided to us or that we have obtained about you, subject to certain exceptions.
Right to Data Portability
You have the right to obtain a copy of your personal data in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another controller without hindrance.

5. How to Exercise Your Rights

Verification

Response Timing
We will respond to your request within 45 days of receipt. If we need additional time, we will inform you of the reason and may extend the response period by up to an additional 45 days.
Appeals
If we decline to take action on your request, you may appeal our decision by contacting us at [email protected] with the subject line "TDPSA Appeal." We will respond to your appeal within 60 days.

6. Data Security
We maintain reasonable administrative, technical, and physical safeguards to protect personal data from unauthorized access, use, modification, and disclosure. These measures include:

- Access controls and authentication requirements
- Regular security assessments
- Employee training on data protection
7. Children's Privacy
Our services are not directed to individuals under 18 years of age. We do not knowingly collect personal data from children. If we learn that we have collected personal data from a child, we will take steps to delete that information.
8. Universal Opt-Out Mechanisms
The TDPSA requires businesses to honor universal opt-out mechanisms (such as Global Privacy Control signals) beginning January 1, 2025. We will honor such signals as required by law.
